Terms & Conditions

The terms that apply when you book a job through FixLink, and the agreement contractors accept before receiving FixLink jobs.

Pricing disclaimer

Pricing is strictly based on the contractor's labour fee. It is not fixed.

FixLink does not publish fixed prices. The price of a job depends on the work, the trade and the contractor doing it. The applicable price should be confirmed before work begins where reasonably practicable, and additional work that increases the price should be approved before it is performed unless urgent action is reasonably necessary.

WhatsApp, SMS, email or another agreed digital channel may be used for booking confirmation and acceptance.

11. General

Digital acceptance: no handwritten signature required

Client must reply:

I AGREE – [FULL NAME] – I CONFIRM THIS BOOKING.

By sending this message, the client confirms that they have received or been given access to these terms and agree to the terms applicable to the booking, subject to rights that cannot lawfully be excluded.

For contractors

Independent Contractor Agreement

Purpose: This agreement is intended to be provided to contractors before they receive FixLink jobs.

1. Purpose and Platform Model

FixLink operates as a platform connecting clients with independent service providers for plumbing, electrical, cleaning, painting, carpentry, gardening, maintenance and related services.

FixLink may facilitate introductions, job coordination, communication and, where agreed, payment administration. The Contractor performs the physical service independently.

3. Payments

The applicable commission, service fee or other commercial arrangement should be communicated or recorded before the relevant job is accepted.

The Contractor must not conceal pricing, collect unauthorised additional amounts or misrepresent the Platform's fee.

4. Job Acceptance and Performance

A job is accepted when the Contractor confirms acceptance through FixLink's designated communication channel or another agreed method.

Additional work or charges must be disclosed to the client and approved before the additional work is undertaken, unless urgent action is reasonably necessary to prevent further damage or danger.

The Contractor must promptly report material delays, access problems, safety concerns, scope disputes or other issues affecting completion.

5. Liability and Responsibility

The Contractor is fully responsible for the quality and completion of their work.

The Contractor is fully responsible for any damage caused to client property arising from their work, subject to applicable law.

The Contractor is fully responsible for any injury, loss or damage arising from their work, subject to applicable law.

The Contractor agrees to repair, replace or compensate for damages caused by the Contractor's negligent, reckless, fraudulent, unlawful or otherwise wrongful conduct, to the extent permitted by law.

Accidental damage, injury, property loss or other material incidents must be reported promptly to FixLink and the client.

6. Materials and Client Funds

The party responsible for purchasing materials must be identified for each job.

If the Contractor purchases materials using client funds, the Contractor must keep receipts and account honestly and accurately for the money.

Client funds must never be used for personal purposes or another job.

7. Safety and Legal Compliance

The Contractor must comply with applicable South African laws, municipal requirements, safety rules, trade standards and professional requirements relevant to the work.

Regulated work may only be performed where the Contractor has the qualifications, registrations, certificates or other authority required by law.

8. Professional Conduct

The Contractor must act professionally, respectfully and honestly.

The Contractor must not engage in theft, fraud, harassment, threats, intimidation, unlawful discrimination, substance-related impairment while working or other misconduct.

9. Confidentiality and Client Information

Client contact details, addresses, job information, pricing information, access information and other non-public information obtained through FixLink are confidential.

Client information may only be used for performing or administering the relevant FixLink job and must not be sold, distributed or misused.

10. Non-Circumvention

The Contractor must not deliberately bypass FixLink to avoid an agreed FixLink fee in relation to a client introduced through FixLink.

For 12 months after the Contractor's last FixLink job for a particular client, the Contractor must not knowingly solicit that client for substantially similar work arising from the FixLink introduction without FixLink's written consent, to the extent lawful and enforceable.

11. Insurance

The Contractor is responsible for obtaining insurance appropriate to the services performed. Public liability insurance is strongly recommended and may be required for particular service categories.

12. Indemnity

To the extent permitted by law, the Contractor indemnifies FixLink against third-party claims, losses, reasonable costs and damages arising directly from the Contractor's negligent, fraudulent, unlawful or wilfully wrongful acts or omissions, or material breach of this agreement.

13. Complaints and Disputes

The Contractor must reasonably cooperate with FixLink in investigating client complaints and job disputes.

FixLink may facilitate communication and take reasonable operational steps to protect clients and the platform while a complaint is investigated.

14. Termination, Suspension and Removal

The Platform may suspend or remove the Contractor at any time for poor performance.

The Platform may suspend or remove the Contractor at any time for misconduct.

The Platform may suspend or remove the Contractor at any time following client complaints.

The Platform may suspend or remove the Contractor at any time for breach of this agreement.

FixLink may also suspend the Contractor from new jobs while investigating serious complaints, suspected fraud, safety concerns, unlawful conduct, non-payment, misrepresentation or material breach.

Termination or removal does not cancel payment, confidentiality, non-circumvention or other obligations that survive termination.

15. Digital Communications and Records

WhatsApp, SMS, email or another agreed digital channel may be used for job instructions, approvals, quotations, notices and acceptance.

The parties should retain relevant messages, quotations, invoices, receipts and job records.

16. Electronic Acceptance

The Contractor may accept this agreement electronically through WhatsApp, SMS, email or another agreed digital communication channel.

The Contractor must send the exact acceptance wording below after receiving and having an opportunity to read the agreement.

17. General

If any provision is invalid or unenforceable, the remaining provisions continue to operate to the extent permitted by law.

This agreement is governed by the laws of the Republic of South Africa.
